Terms of Service

You must be at least 18 years of age to create an account or use the Platform. By using EYS, you represent that you meet this requirement.

EYS is a local marketplace and community directory — shops, events, deals, jobs, yard sales, local history, and a community feed for the Yuba-Sutter region. Features and availability may change as the Platform grows.

Registration. Some features require an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity under your account.

Account types.

• Citizen (free): browse and interact with events, deals, jobs, yard sales, businesses, and community content; post permitted community content, leave reviews, save listings, and connect with neighbors.
• Business Basic (free): an authorized business representative may claim and maintain the business's basic local presence. A paid plan is not required merely to exist in the Directory or hold a basic claimed profile.
• Business FLEX: an optional premium operator plan with a published rate of $29 per month. FLEX may include enhanced page-building and merchant capabilities as they are released. Subscription payment collection is not live yet, so publishing this rate does not itself create a charge or subscription.
• Founding Partner / Founding FLEX: designated businesses in the founding cohort may receive FLEX on a comped basis. Founding status is assigned by EYS and is not self-selected.

You agree NOT to:

• Post false, misleading, or fraudulent content
• Impersonate any person or business
• Harass, threaten, or abuse other users
• Post spam, unsolicited promotions, or chain messages
• Attempt to access another user's account
• Use automated tools (bots, scrapers) to access the Platform without permission
• Post content that is illegal, obscene, defamatory, or infringes on intellectual property rights
• Circumvent any security features of the Platform
• Claim or manage a business profile you do not own or have authority to represent

We reserve the right to suspend or terminate accounts that violate these terms.

Suggested businesses. The directory may include publicly available business listings we have compiled. These are informational until claimed by the business.

Claiming a business. A business owner or authorized representative may claim a listing to manage permitted business information. You may only claim a business you own or are authorized to represent.

Business tools. Basic business presence is free. Certain enhanced operator tools may be designated as FLEX features. Availability of a feature does not create a charge unless the business affirmatively enters a paid subscription after billing is enabled.

Your content. You retain ownership of content you post. By posting, you grant EYS a non-exclusive license to display and distribute that content on the Platform for the purpose of operating the service.

Removal. We may remove content that violates these terms or that is reported and found to be inappropriate. You may report content using the report controls in the app.

Community content. Community posts, reviews, votes, and comments reflect the views of their authors, not EYS.

Citizen use and Business Basic presence are free. The published commercial rate for Business FLEX is $29 per month. Designated Founding Partners may receive FLEX on a comped basis.

Subscription payment collection is not live at this time. No paid FLEX subscription is created and no card is charged merely by creating an account, claiming a business, viewing pricing, or using currently available launch features. Before real subscription billing begins, the Platform will present the applicable plan and obtain any required authorization or consent.

Marketplace/order payment processing is also currently test-only unless explicitly stated otherwise at the point of transaction. EYS does not currently take a percentage commission from ordinary merchant sales under the FLEX plan.

The Platform, including its design, code, and branding, is owned by FitchCraft and protected by applicable law. You may not copy, modify, or redistribute the Platform without permission. Business names, logos, and user content belong to their respective owners.

EYS is provided “as is” and “as available.” We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of business information on suggested profiles
• Results from deals, events, or job listings
• That content posted by users is truthful or reliable

To the fullest extent permitted by law, FitchCraft and EYS shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, or for interactions, transactions, or arrangements between users, businesses, and community members. The Platform is a venue for local connection; it is not a party to any transaction between users.

You agree to indemnify and hold harmless FitchCraft and EYS from any claims, damages, or expenses arising from your content, your use of the Platform, or your violation of these terms.

You may stop using the Platform at any time. We may suspend or terminate access for violations of these terms or to protect the community. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification) will survive.

We may update these Terms from time to time. Material changes will be reflected by an updated date at the top of this page. Continued use of the Platform after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be handled in the state or federal courts located in California.
